Introduction
Cyber Dive Corp. (“Cyber Dive”, “we”, “us” or “our”) knows your privacy is important to you, and we are committed to providing a safe and secure user experience. The following is our Privacy Policy (“Policy”) to ensure that our customers, website visitors, and mobile application users (“Customers” or “you”) are informed of your rights and are provided clear instructions on how to exercise your rights. The purpose of this Policy is to inform you of the types and categories of data that Cyber Dive, including its brands, affiliates, vendors, and service providers collect, use, share, and retain. The Policy also provides instructions on how you can manage your data, and depending on where you reside, you may request the disclosure, deletion, or restriction of any sale or monetization activities of your data.
Cyber Dive operates a service that allows parents and legal guardians to monitor the activities of their children/dependents through a Cyber Dive device and Parent Dashboard, and we also operate a website https://www.cyberdive.co/ (the “Services”). Any of our Services which are utilized by anyone to whom you provide a Cyber Dive Device or access to the Parent Dashboard and is used under your direction and/or supervision are also covered under this Policy.
Currently our Services are only available in the United States, Canada, & Mexico. States may have different standards and requirements in respect of the information we provide in the Privacy Policy and how we use data. This Privacy Policy is governed by the laws of the state specified in the Terms of Use applicable to your Services. Capitalized, but undefined terms used in this Privacy Policy have the meaning assigned to those terms in the Terms of Use.
Your use of our Services is subject to this Privacy Policy and any other terms and conditions of service associated with your device, including the Cyber Dive Terms of Use located at https://www.cyberdive.co/terms-of-use (“Terms of Use”) including the indemnification and limitations of liability provisions contained therein. By using our Services, you acknowledge that you have read and understand this Policy and agree to our Terms of Use. We do not require you to provide your personal information to us to enjoy some of our Services. However, if you do not provide certain personal information, you may not be able to use or access portions of our Services, such as the Device, account features, or account information.
Changes to the Privacy Policy
Cyber Dive reserves the right to change this Policy by publishing new terms on its website at any time. When we do, we will revise the effective date above. Your continued use of our Services after such changes means you understand and acknowledge the Policy as revised. Please periodically review this Policy to stay informed about how we collect, process, and share your personal information.
Categories and Types of Data We Collect
The Account Data, Usage Data and personal data about you or your accounts (hereinafter the "Data") that may be collected by us through use of the Services or the website are as follows:
Account Data. Through the Cyber Dive Services, we collect and process data, which is any information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. We collect this information to offer services, complete transactions, and maintain the highest level of customer service for all of our customers and website visitors. Account Data we collect and process depends on how, where, and why you interact with us. Our proprietary systems review online interactions through registered Devices and Parent Dashboards, including interactions with website, social media platforms, email accounts, and other interactive websites, apps, and platforms which include, but are not limited to posts, comments, images, articles, and other communications. This may include sensitive information such as information about racial or ethnic origin, political opinions or associations, religious or philosophical beliefs, trade union membership or associations, sexual orientation or practices, criminal record or health or genetic information as well as sensitive images such as nudity.
Registration Data. On registering for the Cyber Dive services, we will collect personal information such as name, address, email, payment information (if applicable), user name, passwords, and authorized users (“Registration Data”). Registration Data is mandatory and if not provided, an account cannot be created. Registration Data must be factual and accurate at the time provided.
Location Data. We may collect location information of Devices and other connected devices to our Services. In addition, we may request information about commonly visited locations, such as school or child care, so we may provide our Services.
Cookies. We use cookies and similar technology to collect aggregate (non-personal) information about website usage by all of our visitors and to help us remember you and your preferences when you revisit the Site. These cookies may stay on your browser into the future until they expire or you delete them. We also use technology to remember your purchase selections in your shopping cart. These cookies usually are erased when you close your browser window. Further general information about cookies and how they work is available at www.allaboutcookies.org.
Browsing. We automatically collect information when you visit the website including your device's IP address, browser and operating system, and statistics about how you use the website. If you connect to our website using a mobile device we may also collect information about your device including the operating system and browser used and a unique device identification number. We may collect information from the online interactions of subscribers through other websites, such as social media platforms, email accounts or other interactive sites when you identify those sites to us.
Installed Applications. We may collect information about the applications which are installed on the Device to provide our Services.
Telephone and Text Log Information. We may collect and process certain information regarding phone calls and text messages received and/or sent by the Device, to provide our Services.
Web or Online Forms. If you submit any information to us through web or online forms, including through the use of chat features which may employ the use of artificial intelligence, we collect the data provided in the forms and chats and submitted through these forms or chats by you, including name and email address. Required data to send the online form or engage in the chat is indicated. This data is used for processing your request and contacting you for further communication.
Third Party Cookies. We allow selected third parties to place cookies through the website to provide us with better insights into the use of the website or user demographics or to provide relevant advertising to you. For instance, we allow Google Analytics to place cookies through our website to collect aggregated information about use of our website and website visitors to assist us in our analysis to provide better services to you. These third parties may collect information about a consumer's online activities over time and across different websites when they use our website. We may also permit third party service providers to place cookies through our website to perform analytic or marketing functions where you are notified of them and you have consented to the usage. We do not control the use of such third party cookies or the resulting information and we are not responsible for any actions or policies of such third parties.
Do-Not-Track. We do not use technology that recognizes a “do-not-track” signal from your web browser.
Information Collected Indirectly. Our Services collect and analyze data acquired from third party applications used on your Device, including YouTube. With respect to YouTube, we use YouTube’s Application Programming Interface (“YouTube API”) to collect data from YouTube concerning videos that have been posted or accessed via the YouTube platform from your Device. Note: Cyber Dive will have access to the content of private e-mail communications, text messages, private or direct messages, and other in-app communications that are transmitted using Cyber Dive Services.
How Data is Used
Commercial Communication. Cyber Dive uses your personal information for various purposes, including but not limited to, billing purposes such as an auto-renew program, to provide or change service, to anticipate and resolve problems with your service, for fraud prevention purposes, to comply with legal requirements, to communicate with you, to manage and administer our websites and services, for auditing and accounting purposes, to collect and process transactions, or to inform you of products and services that better meet your needs.
Registration Data. We are responsible for processing your Registration Data, which is used for communications with you and for the provision and management of your use of our Services. It is also used to measure and improve the Services and functionality and to provide customer service, send email notifications and (unless no longer in the distribution list) newsletters, or communications, in general, about the Services, products and novelties, and offers or promotions offered by us. We will use the Registration Data for these purposes and to comply with the Terms of Service applicable to your Services and other legal notices.
Data. You and, if applicable, your Device user(s) and authorized users (collectively, your “Authorized Users”), will be sent notification emails, texts and other reports concerning certain Data monitored by the Services. Your Authorized Users will have access to all Data in our possession for review and, if necessary, correction. Your Authorized Users may request access to such Data by e-mailing our customer support. If the Authorized User is a minor, all requests for Data must be made through their parent or legal guardian.
Data Processing
Your use of User Data. As Data Controller, you warrant that you have the appropriate authority to collect and process the User Data and you agree to (i) process and use the User Data in accordance with this Privacy Policy, the applicable Terms of Use and applicable law (including any laws in the country where you reside or make beneficial use of the Service). You will not submit to the Services any personal data relating to any individual that has not authorized such processing (unless you are permitted to authorize such processing on that person’s behalf in accordance with our Terms of Use and applicable law). You will protect the confidentiality of any accessible User Data and prevent access by or disclosure to any unauthorized third person. You will inform us within 24 hours about any problem arising in relation with management of your account(s) and/or User Data. You and your Authorized Users will be responsible for any illegal use of other person’s data (personal or not) through the Services, including any use contrary to applicable data protection laws and/or in violation this Privacy Policy.
User Data. Upon your registration for, and deployment of, the Cyber Dive Services, we start collecting Data from the Devices and applications associated with the account(s), which may include personal data relating to you, to your accounts, you Authorized Users or to third parties, including information about your Devices used by accounts, websites and applications that your accounts use, and contacts, connections, payments, images, messages and other communications, posted and received by your accounts and/or Authorized Users (collectively, “User Data”). In accordance with applicable privacy law, to the extent that it applies to the Services, you and your Authorized Users are the respective Data Controllers (or the Responsible Party/ies) of this User Data and you appoint Cyber Dive as a Data Processor of such User Data for the purpose of providing our Services. For clarity, where the concepts of “Data Processor” and “Data Controller” are not expressly contemplated by the applicable privacy laws, the parties' obligations in connection therewith will be interpreted under those applicable privacy laws to align as closely as possible with the scope of those roles while still complying fully with those privacy laws. User Data is not our property or under our control and is only monitored by us for purposes of providing the Services. Any User Data that combines personally identifiable information with non-personally identifiable information will be treated as personally identifiable information. We will take reasonably appropriate steps to maintain the accuracy of any User Data we collect.
Service Configuration. The Services provide Device and application monitoring services for accounts as described in this Privacy Policy and the applicable Terms of Use. As part of the same, significant amounts of User Data may be collected and transmitted by the Services to Cyber Dive. You are responsible for setting the configuration of the Services that (i) controls the supervision and monitoring of activities, and (ii) determines the personal data to be monitored and collected. The setting of those configurations constitutes instructions by you for us to process User Data on your behalf as necessary to provide you the Services. The level and degree of such surveillance and monitoring is entirely under your control and we will not be liable for any such configuration and control carried out by you. All such User Data will be under your responsibility, with Cyber Dive as data processor in accordance with this Privacy Policy.
Data Processor Obligations. To the extent that Cyber Dive is a Data Processor on your behalf, we shall (a) implement appropriate technical and organizational measures to safeguard any User Data against any unauthorized or unlawful access, loss, destruction, theft, use or disclosure; (b) limit access to User Data only to those employees who need to know it to enable us to perform the Services; (c) only process the User Data as specified by this Privacy Policy and in accordance with your instructions, and (d) will not use the User Data for purposes other than those related to the performance of the Services or pursuant to your written instructions. Upon the expiry or termination of this obligation by way of de-registration, or upon your request, we will cease any and all use of the User Data and will destroy it to the extent legally required. Other than as described in this Privacy Policy or the applicable Terms of Use, we will not disclose User Data to any third party without your prior written consent or pursuant to court or administrative order. We may retain User Data as lawfully permitted, or as required by court or administrative order.
Subcontracting. As Data Processor we may provide access to any User Data to a subcontractor processor if we reasonably consider such access and processing necessary to the performance of the Services. In the event of such access and by a subcontractor or any other third-party, before the access takes place, we shall require that an agreement with the third party is in place which is sufficient to require it to treat personal data in accordance with the applicable provisions of this Privacy Policy. In particular, you authorize us to subcontract to the third parties mentioned in the following section on international transfers.
Data Retention. We will only retain Data for as long as necessary to fulfill the purposes we collected it for, including (a) the performance of the Services, (b) for the purposes of satisfying any legal, accounting, or reporting requirements and (c) to follow your instructions regarding data collected from the Devices. To determine the appropriate retention period for Data, we consider the amount, nature, and sensitivity of the Data, the potential risk of harm from unauthorized use or disclosure of the Data, the purposes for which we process the Data and whether we can achieve those purposes through other means, and the applicable legal requirements. Generally, we will retain your Data for the period of your active use of the Service and 5 years thereafter, for legal and/or administrative purposes. Each account’s User Data is controlled by the account and/or you as a Data Controller. We do not control any User Data and cannot and will not provide access in response to any account’s request to review or correct errors in their User Data, unless otherwise required by applicable law. We will forward any such requests received by us to you and you will be responsible for responding to any such requests.
Warranties. You, as the party responsible for User Data that we process on your behalf as Data Processor for the provision of the Services, represent and warrant to us that:
You comply with all applicable laws with respect to the monitoring and control of Device(s), Parent Dashboard(s), and applications used by you or your accounts; and
You have all legally required informed consents from or on behalf of each and every data subject, including without limitation, each account, whose personal data are submitted to us in the course of the provision of the Services or collected and transmitted to us by the Services.
Indemnity. You agree to indemnify and hold us harmless from all claims, damages and losses we may suffer relating to or arising out of the processing of User Data and other third party personal data submitted to our systems during the course of your use and our provision of the Services.
International Transfers of Data.
We use third party technological services for the provision of Services, whose providers may process Registration Data and User Data collected in the course of providing us their services, as sub-processors. You authorize us to subcontract the services and the corresponding transfer of User Data to the entities and countries.
Children's Privacy.
The website and Services are designed to be a tool for parents and others to use to facilitate safe online interactions for their respective Authorized Users. Only those over the age of 18, or those with the valid consent of their parent or legal guardian who is over the age of 18, may subscribe to our Services. This website is not designed nor intended to be attractive to children under the age of 13. While our Services include analysis of online interactions by children, we do not knowingly collect data from children under the age of 13 without first receiving verified consent. If you are under 13 please do not submit any information to us.
Analytics and other anonymous data use.
For the purpose of analyzing and improving our Services, we may anonymize your Data and store and process this anonymized data. This anonymized data is used only for our internal analysis to determine how our Services are used, measuring effectiveness, and providing general customer service. We may share aggregated and anonymized information we collect with third parties, including our service providers and affiliates, for the purpose of conducting general business analysis.
Data Security.
Cyber Dive has adopted technical and organizational measures to preserve and protect your Data (including User Data) that we monitor from unauthorized use or access and from being altered, lost or misused, taking into account the technological state of art, the features of the information stored and the risks to which information is exposed, including without limitation encryption of all Data at rest and in transit. However, due to the nature of the information and related technology, we cannot ensure or guarantee the security of your Data and expressly disclaim any such obligation. If we learn of a security breach, then we will attempt to notify you electronically as soon as reasonably possible (and within any timeframes specified in our agreements with you, if applicable) so that you can take appropriate steps. You have a role in the security of your information and you are responsible to make sure your login information is not shared with or accessible by other people. If your login information is lost or stolen, you can change your login information on the Device, Parent Dashboard, or website, as is applicable. In addition, you may contact customer service for assistance with securing your login. If we receive instructions using your login information we will consider that you have authorized the instructions.
Accessing Your Information and Your Choices.
You may have the right to access, rectify, erase, block and oppose any processing of your personal data that we may have. You can update, amend or delete your contact information at any time by visiting the account information page on the Parent Dashboard. You can update or change your billing and payment information on the Parent Dashboard. You can choose not to receive promotional emails from us by “unsubscribing” using the instructions in any promotional email you receive from us. This will not stop us from sending emails about your account or your transactions with us. You can choose to delete or block cookies by setting your browser to either reject all cookies or to allow cookies only from selected sites. If you block cookies, performance of the website may be impaired and certain features may not function at all. Moreover, you may at any time withdraw your consent to the processing of your personal data and information. This withdrawal will not have retroactive effects but may prevent us from providing the Services. The above is without prejudice to applicable law enabling conservation of your data for the purpose of defending our responsibility and complying with mandatory legal obligations. Consent.
By registering for the Services and creating an account, you declare to have read and acknowledge the terms of this Privacy Policy. Without prejudice to the generality of the foregoing, you expressly and unequivocally consent to:
the collection and processing of your Data (or the Data of any other person, including your Authorized User(s), on whose behalf or for whose benefit the Services are provided in relation to your agreement with us, as contemplated by the applicable Terms of Use) by us in accordance with the indicated purposes and this Privacy Policy;
the collection and processing of User Data on your behalf, as indicated herein; and
the processing of all personal data stated in this Privacy Policy by authorized subcontractors.
Your consent to personal data collection and processing may be revoked, without retroactive effects, in accordance with applicable law.

If you access Cyber Dive’s Services, or use one of our Devices outside of the United States, you fully understand and unambiguously consent to the transfer of your Data to, and the collection and processing of such data in the United States. Privacy laws in these countries may not provide protections equivalent to those of your country of residence, and your government may or may not deem such protections adequate.
Public Blogs
Our website offers publicly accessible blogs. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. You should not provide personally identifiable information in any publicly accessible blog.To request removal of your personal information from our blogs contact us at support@cyberdive.co, and we will do our best to comply with the request. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.
Referrals
We allow you to refer your friends and contacts to Cyber Dive. If you choose to utilize these features, we’ll use and store the information provided only for purposes of sending the invitation emails or notifications you have requested. If you utilize these features, the friends or contacts that you refer may contact us at the contact information listed below to request that we delete their personal data.
Gift Purchases
If you purchase a gift, we will ask you for the recipient’s name, and mailing address to ship product to the individual. Cyber Dive may retain the recipient’s information but will not use it for other purposes.
Social Media Features
Our website includes social media features and widgets. These features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features and widgets are either hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the company providing the feature or widget.
Surveys
Occasionally, we may conduct surveys on our website. Surveys are conducted at random and are completely voluntary to our website visitors. The survey may require you to provide Data in exchange for the information or services provided by the survey. You may access, review, correct, and delete certain of your personal data by logging into your Parent Dashboard or Cyber Dive account.
Your Legal Rights.
Individuals outside the United States, and residents of designated U.S. states have certain legal rights to request that we:
• confirm whether we hold personal data about them,
• provide access to personal data we hold about them (including, in some cases, in portable form),
• update, amend and/or correct personal data we hold;
• delete certain personal data in appropriate circumstances; and/or transfer personal data to a third-party provider of services.

FOR NEVADA RESIDENTS: YOUR NEVADA PRIVACY RIGHTS
Nevada consumers have a right to submit a request to opt-out of sale of personal information, referred to under the Nevada Privacy Law as “covered information.” Upon receipt of a verified request, both as to the submission and the identity of the consumer, Cyber Dive will process your request in accordance with the Nevada Privacy Law. Cyber Dive will further notify the customer within 60 days after receipt that the request has been processed. At this time, Nevada residents can only submit this request by sending a request with appropriate identification documents to support@cyberdive.co.

This California Consumer Privacy Act ("CCPA") Supplemental Privacy Notice for California Residents (this "CCPA Policy") is included in our Privacy Policy and applies to Cyber-Dive Corp. (“Cyber Dive”, “Company”, “we”, “us” or “our”)’s processing of personal information of California consumers (as the terms "personal information" and "consumer" is defined under the CCPA) (collectively, "Consumers," "you," or "your"). Any capitalized terms or other terms not defined herein shall have the meaning ascribed to them in the Privacy Policy or, if not defined herein or in the Privacy Policy, the CCPA. To the extent of any conflict between this CCPA Policy and the rest of our Privacy Policy, this CCPA Policy shall control only with respect to Consumers and their personal information. These categories are ONLY collected in very limited circumstances where the consumer voluntarily and knowingly provided the information.
Commercial information. Records of products or services purchased, obtained, or considered.Internet or other similar network activity. Browsing history, search history, information on a consumer’s interaction with a website, application, or advertisement.
Geolocation data. Physical location or movements.
Inferences drawn from other personal information. Profile reflecting a person’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.
Personal information does not include de-identified or aggregated consumer information.
Sources of Personal Information Collected. We obtain the categories of personal information listed above from the following categories of sources: directly from you, such as when you make a purchase, subscribe to the Services, or complete forms; indirectly from you, such as observing your actions on our website, interactions with applications, and from publicly available sources.
Disclosures for a Business or Commercial Purpose.
In the preceding 12 months, Cyber Dive has disclosed the types of personal information listed above to its service providers for business purposes.

“Do Not Sell” Rights
We may disclose your personal information for the following purposes, which are not a sale: (i) if you direct us to share personal information; (ii) to comply with your requests under the CCPA; (iii) as part of a merger or asset sale; and (iv) as otherwise required or permitted by applicable law.
We do not believe that we sell California Consumer personal information as defined under the CCPA. Until such time as we change our practices and update this Notice, we will treat personal information collected under this Notice as subject to a “do not sell” request. However, although there is not yet an industry consensus, we do not believe that the collection of data by third-party cookies and other technologies on our website and online services is a sale of your personal information by us. Your CCPA Rights
Access. You may request access to the personal information that we have collected and maintained about you (along with information regarding its use and disclosure) over the past twelve (12) months upon appropriate verification. You may only make such requests twice (2) per every twelve (12) months.
Deletion. You have the right to request that we delete personal information collected and maintained about you, subject to certain exceptions. Once your request is verified and we have determined that we are required to delete that information in accordance with applicable law, we will delete your personal information accordingly. Your request to delete your personal information may be denied if it is necessary for us to retain your information under one or more of the exceptions listed in the CCPA. NOTE: If you request a deletion and have an active account, your request will remain pending until you close or delete your account.
Verifying Your Request. Only you, or a person that you authorize to act on your behalf, may make a request related to your personal information. In the case of access and deletion, your request must be verifiable before we can fulfill such request.
Verifying your request will require you to provide sufficient information for us to reasonably verify that you are the person about whom we collected personal information or a person authorized to act on your behalf (e.g., previous transactions of person to whom request relates).
We will only use the personal information that you have provided in a verifiable request in order to verify your request. As stated above, we cannot respond to your request or provide you with personal information if we cannot verify your identity or authority.
Please note that we may charge a reasonable fee or refuse to act on a request if such request is excessive, repetitive, or manifestly unfounded.
Your California Privacy Rights under the "Shine the Light" Law
Pursuant to Section 1798.83 of the California Civil Code (a separate law from the CCPA), residents of California have the right to obtain certain information about the types of personal information that companies with whom they have an established business relationship (and that are not otherwise exempt) have shared with third parties for direct marketing purposes during the preceding calendar year, including the names and addresses of those third parties, and examples of the types of services or products marketed by those third parties. Do Not Sell My Personal Information
If you are a California resident, the California Consumer Privacy Act (CCPA) provides you the right to request that we do not sell your personal information to third parties (“Do Not Sell Request”). California "Do Not Track" Notice
Most web browsers and some mobile operating systems include a Do-Not-Track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.
